For decades, applicants were limited to black-and-white linework, relying on hatching and shading to convey detail. This often-left critical distinctions buried in dense illustrations, creating unnecessary room for misinterpretation. With the introduction of colour, that limitation is removed.     The European Patent Office has updated its practice, and from 1 October 2025, applicants may include color drawings for European patents in applications filed electronically. This means that from this date onwards, both greyscale and patent drawings in color will be officially accepted, provided they meet the EPO’s technical standards.
    It is not compulsory to use patent drawings in color. Applicants may continue to file drawings in black and white, switch entirely to greyscale or color, or mix these formats in a single application. While the new flexibility is useful, many applicants may still prefer black-and-white drawings, especially when filing internationally, since not all jurisdictions follow the new EPO color drawings rules.
    No. The option to use color drawings for European patents applies only to electronically filed applications. If you submit your application on paper, the traditional requirement for black-and-white line drawings still applies, and color will not be accepted.
    Yes. A major change under the EPO color drawings rules is that drawings filed electronically in greyscale or color will be published and made available in the public file exactly as they were filed. Unlike in the past, they will no longer be automatically converted into black and white during publication.
    The new rules apply only to European applications. Under the PCT system, patent drawings in color are still not admissible for international publication, and any submitted color drawings will be converted into black and white. However, the original color versions may be accessible via WIPO’s PATENTSCOPE database for reference.
    If a PCT application entering the European phase on or after 1 October 2025 contains color drawings for European patents, the EPO will process them in color only if the international publication states that color drawings are available on PATENTSCOPE. If this condition is not fulfilled, the EPO will rely on the black-and-white version instead.
    No. Even though the EPO color drawings requirement now allows the filing of drawings in color, the invention itself must not depend on color features. References such as “the blue layer” or “the red part” in the description, claims, or abstract are discouraged and may be ignored during examination. Applicants should always define technical features without relying on color.
    In most cases, you cannot replace black-and-white drawings with patent drawings in color after filing. Replacement or corrected drawings must match the original submission. Color versions may only be accepted if the original filing disclosed them in color from the beginning.
    Yes. One of the advantages of the new EPO color drawings rules is that applicants can mix formats within the same filing. You may submit some figures in black and white and others in color or greyscale, as long as the overall application remains consistent and compliant with the technical standards.
    Yes. The EPO color drawings requirement specifies that all drawings, whether in color, greyscale, or black and white, must be durable and use uniform, well-defined lines and strokes. They must also have sufficient contrast and be suitable for reproduction at 300 dpi resolution. These technical standards ensure that drawings remain clear during examination and publication
    They might. While the EPO now allows patent drawings in color, many non-European patent offices, including the PCT system, still only accept black-and-white drawings. For this reason, applicants pursuing protection in multiple jurisdictions should be prepared to submit a black-and-white version of their drawings alongside their color drawings for European patents.
    Yes, amended drawings filed electronically after 1 October 2025 may be submitted as patent drawings in color or in greyscale. However, they must not add new subject matter beyond what was originally disclosed in the application, and they must comply with all EPO color drawings rules on format and quality.
    Yes. Translations and divisional applications must reproduce drawings in exactly the same format as the original application. If the parent application included color drawings for European patents, then those drawings must remain in color in the translated version as well.
